"Free Electricity in 2010" Sweepstakes
1) No Purchase Necessary: One way to enter. Go to www.freeelectricityin2010.com, complete the official entry form and click “enter”. All entries must be received between 12:00:01 a.m. (EST) on Monday, May 10, 2010 and 11:59:59 p.m. (EST) on Tuesday, December 21, 2010. Only an eligible entry is required (restrictions below). Sponsor’s computer is the official timekeeping device for the Sweepstakes. Limit one entry per person and per e-mail address. Sponsor will not verify receipt of entries. Automated entries are prohibited, and any use of automated devices will cause disqualification. No mechanically reproduced entries will be accepted. Sweepstakes starts on May 10, 2010 and ends on December 21, 2010.
2) Prizes: 50 prizes in total will be awarded; details listed in section 3 "Drawing". No matter the length of the awarded "free electricity", the monthly limit that Public Power will cover shall not exceed $250 per month. Anything above that will be billed to the winner of that specific drawing. Odds of winning depend on the number of eligible entries received.
3) Drawing: Starting on May 10, 2010, Sponsor will pick 1 person per week to win one month of "free electricity". Starting June 1, 2010, one winner will be selected bi-weekly to win 3 months of "free electricity". On August 13, 2010, one winner will be selected to win 6 months of "free electricity". On October 15, 2010, one winner will be selected to win 6 months of "free electricity". On Decemeber 31, 2010 one winner will be selected to win one year of "free electricity".. Winners will be selected from among valid entries received by 11:59:59 p.m. (EST) on Tuesday, December 21, 2010. Winner need not be present to win. Verification and proof of eligibility will be required in order to qualify as winner. Drawing and notification will be done by an employee of Sponsor or an employee of Sponsor’s advertising or promotion agency.
4) Eligibility: Sweepstakes is open only to legal residents of the United States, 18 years of age or older who are customers of a licensed electric company and have a valid e-mail address as of May 10, 2010. Entry form must be in the name of the electric company customer. Employees and household family members of Sponsor, its advertising, promotion, printing, production, web development and web design agencies, and their respective parents, subsidiaries and affiliates are not eligible. Void where prohibited or otherwise restricted by law. Prize is not transferable. In the case of a dispute regarding who submitted a particular online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account. Federal, state and local taxes and regulations apply. Taxes are the winner’s sole responsibility and a 2010 Form 1099 may be issued to winner in the amount of $300/month (or less if applicable).
5) Notification and Confirmation: The potential winner will be notified by email to the email address listed in the entry email or through other means of communications at Sponsor's sole discretion (“Sponsor’s Notification”). It is entrant's responsibility to keep his/her email address current. The potential winner will have ten business days to reply to the Sponsor’s Notification, agreeing to accept the Prize and providing/confirming full contact information (“Potential Winner’s Confirmation”). The potential winner will have thirty business days from the date of Sponsor’s Notification within which to mail (via USPS) or e-mail to the Sponsor (at promotions@ppandu.com) a copy of his/her next monthly electric bill (“Next Month’s Bill”). After receipt of Next Month’s Bill, Sponsor will forward to the winner a check in the amount of $300 or the amount appearing on Next Month’s Bill, whichever is less. Allow up to four weeks for processing payment. Sponsor not responsible for making any payment to the electric company. Failure of potential winner to provide Potential Winner’s Confirmation or deliver a copy of Next Month’s Bill within the above time limits will signify to Sponsor that the Prize has been declined and forfeited and another potential winner will be chosen in a random drawing.
6) Limitation and Liability: All interpretations of the rules and decisions by Sponsor are final. Entry constitutes winner’s permission to use his/her name, photograph, and/or voice recordings for advertising or publicity purposes, in all media, without additional compensation or permission, except where prohibited by law. Sponsor, its promotion and advertising agencies, and all respective officers, directors, employees, representatives and agents shall have no liability and shall be held harmless for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of acceptance or participation in this Sweepstakes. Any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or the Prize, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney’s fees. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Sweepstakes if virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Sweepstakes. In such event, Sponsor may award the Prize in a random drawing from all eligible entries received up to the time of cancellation or suspension. Sponsor and its promotion and advertising agencies are not responsible for technical, hardware, software or telephone failures of any kind, or unavailable network connections, fraud, incomplete, misdirected, garbled or delayed entries or computer transmissions, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the promotion. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning the Prize if, in Sponsor’s sole discretion, it determines that the entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE SPONSOR’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND IF SUCH ATTEMPT IS MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
